 Privacy Policies

GENERAL
Business hours are Monday-Friday 8:00 a.m. to 5:00 p.m. Eastern Standard Time. All orders placed after 4:00 p.m. EST will be processed on the next business day.

Prices are F.O.B. Amherst, New Hampshire and subject to change without notice. All product sales are subject to the terms and conditions of sale set forth on Monarch Instrument's Invoice.

REPAIR AND CALIBRATION SERVICE: All items being returned to Monarch Instrument for repair and/or calibration must have an RMA Number and be shipped prepaid by customer. Items accepted for Warranty repair are serviced at no charge in accordance with the terms of Monarch Instrument’s Warranty. Physically damaged or out of warranty items will be repaired and returned on a time and materials basis.  All items returned to Monarch, but found to have no problem, will be subject to a $50.00 evaluation fee. Repaired items will be returned to the customer postage-paid.

HARDWARE PRODUCTS LIMITED WARRANTY MONARCH INTERNATIONAL, INC. (“SELLER”) warrants hardware products supplied by it to be free from any defects in materials or workmanship for a period of one (1) year from the date of shipment to BUYER.  SELLER’s entire liability, and BUYER’s sole and exclusive remedy, resulting from any defects in workmanship or material in the hardware product covered by this limited warranty shall be limited to and fully discharged by, at the SELLER’s option, either the repair of such hardware product or its replacement with the same or a like product without charge.  

SOFTWARE PRODUCTS LIMITED WARRANTY SELLER warrants that any software product supplied by it will operate substantially in accordance with the documentation or manual supplied therewith in all material respects when used in strict compliance with such documentation or manual.  Notwithstanding the foregoing, BUYER acknowledges that, since software is complex and therefore may have defects, BUYER’s sole and exclusive remedy for any such defects in the software products or for breach of this warranty shall be to require SELLER, within a reasonable period of time, to provide all reasonable programming services to correct programming errors in the software product.  

FIBERSCOPES LIMITED WARRANTY: SELLER warrants Model FSX and FSI Fiberscope products to be free from any defects in materials or workmanship for a period of ninety (90) days from the date of shipment to BUYER. SELLER’s entire liability, and BUYER’s sole and exclusive remedy, resulting from any defects in workmanship or material in the hardware product covered by this limited warranty shall be limited to and fully discharged by, at the SELLER’s option, either the repair of such hardware product or its replacement with the same or a like product without charge.

EXTENDED LIMITED WARRANTY PROVISIONS BUYER may purchase from SELLER an “Extended Limited Warranty” which will extend the duration of the limited warranties hereunder from a period of one (1) year to a period of three (3) years from date of shipment to BUYER. With respect to each Extended Limited Warranty, all terms, conditions, restrictions, limitations and exclusions other than the duration remain the same as set forth above.  SELLER’s invoice and/or BUYER’s purchase order shall state whether the Extended Limited Warranty is applicable, and, if so, which products are covered by such Extended Limited Warranty. 

GENERAL PROVISIONS APPLICABLE TO HARDWARE AND SOFTWARE PRODUCTS:  THE LIMITED WARRANTIES PROVIDED ABOVE ARE IN LIEU OF ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESSED OR IMPLIED, ARISING BY LAW OR OTHERWISE.  EXCEPT AS PROVIDED ABOVE, SELLER MAKES AND BUYER RECEIVES FROM SELLER NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO ALL OR ANY PORTION OF THE HARDWARE OR SOFTWARE PRODUCTS AND BUYER HEREBY AGREES AND ACKNOWLEDGES THAT IT ACCEPTS THE HARDWARE AND SOFTWARE PRODUCTS IN ‘AS IS’ CONDITION. SELLER HEREBY EXPRESSLY EXCLUDES ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE HARDWARE AND SOFTWARE PRODUCTS.  BUYER agrees that any specific right or remedy granted to BUYER hereunder with respect to any breach or default by SELLER relating to any hardware or software products supplied by SELLER, or with respect to any failure of such products, shall be in lieu of all other rights and remedies otherwise available to BUYER at law or in equity as the result of such breach, default, or failure, regardless of whether based on contract, tort, strict liability, or other theory of liability.  SELLER’s entire liability with respect to any such breach, default, or failure, and BUYER’s sole and exclusive remedy, shall be as set forth above in the respective limited warranty sections. 

IN NO EVENT SHALL SELLER BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE LOSSES OR DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSSES OR DAMAGES FOR ANY LOST PROFITS OR LOST DATA) AS THE RESULT OF ANY BREACH OR DEFAULT BY SELLER WITH RESPECT TO THE HARDWARE OR SOFTWARE PRODUCTS, OR ARISING AS A RESULT OF THE FAILURE OF SUCH PRODUCTS, EVEN IF SELLER HAS BEEN ADVISED OR MADE AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES OR DAMAGES AND REGARDLESS OF WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHER THEORY OF LIABILITY.

The limited warranties above do not extend or apply to any defects, failures, or damage resulting from: (a) misuse of the product; (b) use of the product in other than its normal and customary manner; (c) accident, neglect or contamination; (d) improper testing, operation, maintenance, service, repair, installation or storage; (e) unauthorized alteration or modification of the product; or (f) use of the product with any other hardware or software with which such product was not intended to be used. The limited warranties above do not extend or apply to consumables or accessories (including, but not limited to, reflective tape, lamps and batteries, if applicable) or equipment, instruments or accessory items which are warranted separately by the original manufacturer of these items. 

The provisions of these Limited Warranties shall be governed by the laws of the State of New Hampshire without regard to the conflict of laws principles thereof. These Limited Warranties shall not be modified except by an agreement signed by both parties specifically referencing these Limited Warranties.

Minimum Order
Monarch Instrument has a minimum order of $50.00 per order.
Re-Stocking Fee
There is a 25% restocking fee for any product that is returned to Monarch Instrument in "like-new" condition. If the product is not in "like new" condition, a 25% restocking fee and a repair charge will apply.

How is Personal Information Collected?
Personal information might be collected from you in several ways:

When you buy
When you purchase an item from a Monarch (seller), we require your name, e-mail address, phone number, billing address and shipping address. For credit card transactions, we require your credit card number and credit card expiration date. 

When you submit feedback about the Monarch Instrument service

We ask that you include your e-mail address and name when providing feedback about the Monarch Instrument service.

When you visit our site

The way the World Wide Web works, when you visit our site, we automatically receive the web address of the site that you visit just before you come to Monarch Instrument, and just after you leave us. We use this information only in the aggregate and only to learn more about our customers interests and preferences so that we may better serve you.

When we send you e-mail

We use software that enables us to track whether you support HTML e-mail in your e-mail client, such as Microsoft Outlook, Lotus Notes or AOL. We also use such software to determine whether an HTML e-mail message has been opened or previewed, however, we cannot track the open rate on text-only e-mail messages. We use this capability only to deliver the best content to you. Please note that you can override the "HTML Capable" setting in your e-mail client.

When you enter a contest or other special promotion
We may ask you to provide your name, e-mail address, and shipping address.

How is Personal Information Used?

When we provide our service.
Monarch Instrument requires certain personal information to be provided when buying products. Among other uses, this information is necessary for Monarch Instrument to provide its basic product offering. For example, a buyer who places an order is required to provide personal information (e.g., name, e-mail, phone, shipping address, credit card number, etc.) so that Monarch Instrument can among other things verify the buyer's identity, process the transaction, verify receipt of payment, confirm shipment information, and provide status reports related to the order. Information collected from sellers is used similarly.

When we try to improve.
Information collected when providing feedback about the Monarch Instrument service is necessary so that Monarch Instrument may contact users for clarification or additional help in improving our product offering. Information collected during contests is used to administer promotions.

When we notify our customers.
In addition, Monarch Instrument maintains several e-mail lists to keep Monarch Instrument members informed about our products and services as well as latest breaking events. However, Monarch Instrument protects its users from unsolicited mail contact.

How is Personal Information Disclosed?
Monarch Instrument does not sell, disclose, transfer, rent, loan, trade, or lease individually identifiable user information to any third parties collected at our site, including e-mail lists or Web site logs, except to provide Monarch's basic service and to provide information about Monarch Instrument products, offers, and events, and except as we explain below. The following describes the ways that your personal information may be disclosed.

The Basic Product Offering.
In order to provide our services, Monarch Instrument must disclose some personal information to other companies, and these companies may disclose personal information about you to us. For example, Monarch Instrument and other companies may exchange personal information about you in order to verify a buyer's identity or credit rating, process a transaction, verify receipt of payment or confirm shipment information. This may include information we received from our co-branded partners about you.

Further, Monarch Instrument must disclose some personal information to individual manufactures, at their request. Such disclosures may include information enabling the Manufacturer to compare a buyer's shipping address or zip code against his or her credit card billing address or zip code.


Disclosure for Marketing Purposes and Joint Marketing Arrangements.
Monarch Instrument currently uses a third-party e-mail marketing firm for the purpose of managing e-mail communications with customers, such as outbound marketing promotional e-mails. For these mailings, we generally share e-mail lists and other personal information to execute the mailing, however all such information is kept strictly confidential.

Further, while Monarch Instrument does not currently have any joint marketing arrangements with third parties, we may enter into such agreements in the future. To the extent permitted by law, Monarch Instrument reserves the right to disclose the information we collect, as described above, to companies that perform marketing services on our behalf or to other third parties with whom we may enter joint marketing agreements.

From time to time, Monarch Instrument collects and may share aggregated demographic or usage information about our site for marketing and other purposes. However, such information does not identify our users individually.


Disclosure for Legal and Regulatory Requests.
Monarch Instrument cooperates with all law enforcement and regulatory authority inquiries and will release information about you if we are compelled to do so. We may also disclose information about you in other circumstances as permitted by law as we, in our sole discretion, believe necessary or appropriate. For example, we may release information in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us or you to legal liability. Further, due to the existing regulatory environment, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy; for instance, third parties may unlawfully intercept private communications.

How Does Monarch Instrument Use Cookies? A cookie is a small data file that is placed on your hard drive. Among other things, Monarch Instrument may use cookies to load your personal settings and preferences information. We protect information cookies with encryption and Secure Sockets Layer (SSL) technology, the industry standard for secure commerce transactions.

How Does Monarch Instrument Secure Your Information? When you conduct a transaction on our site we encrypt all of your private information. That information is then stored in a secure data center. All transactions are conducted through our secure servers, which are protected behind sophisticated firewalls. However, "absolute, 100%" security does not exist on the Internet.

Notice of Policy Changes?
From time to time, we may change this Privacy Policy based on your comments and our need to accurately reflect our data collection and disclosure practices. As required by federal law, we will notify you of any changes to our Policy.
